AI governance has moved from a theoretical concern to a regulatory reality. The EU AI Act is now in force, the UK government has published its own framework for AI regulation, and businesses of all sizes are grappling with what responsible AI actually looks like in practice. The challenge is that most guidance on AI governance is either too abstract to be useful or too technical for business leaders to act on.

The EU AI Act: What You Need to Know

The Act classifies AI systems into four risk tiers, each with different obligations.

Unacceptable Risk

High Risk

Systems used in critical areas such as recruitment, credit scoring, law enforcement, education, and essential services. Limited Risk

What UK Businesses Need to Know

The UK has taken a different approach, favouring sector-specific regulation through existing regulators rather than creating a single comprehensive law. The five principles set out in the UK's framework are: safety and security, transparency and explainability, fairness, accountability and governance, and contestability and redress.

However, UK businesses cannot afford to focus solely on domestic regulation. If you have EU customers, use EU-based cloud services, or process data from EU citizens, the EU AI Act applies to you. The practical approach is to build governance that meets the higher standard, ensuring compliance regardless of which jurisdiction you are operating in.

Building an AI Inventory

You cannot govern what you do not know about. The first step in any AI governance programme is creating a comprehensive inventory of every AI system your organisation uses or plans to use. This is often more revealing than expected.

For each system, document the purpose and use case, what data it processes, who it affects, what decisions it influences, who is responsible for it, and what risk tier it falls under. An effective AI governance framework does not need to be enormous. It needs to be actionable. Focus on these core components.

Policies

Clear, written policies covering acceptable use of AI, data handling requirements, procurement standards for AI vendors, and incident response procedures. These should be accessible and understandable, not buried in hundred-page documents that nobody reads.

Roles and Responsibilities

Assign clear ownership. This typically means an AI governance lead or committee, system owners for each AI deployment, and designated reviewers for high-risk applications. Without clear ownership, governance becomes everyone's problem and therefore no one's priority.

Review Boards

For high-risk applications, establish a review process before deployment. This should assess the system's purpose, data requirements, potential biases, transparency measures, and ongoing monitoring plans. The goal is not to create bureaucratic bottlenecks but to ensure that high-impact systems receive appropriate scrutiny.

Data Protection Overlap

AI governance and data protection are deeply intertwined. If your AI processes personal data, and most do, you need to consider GDPR requirements alongside AI-specific governance. Key areas include data minimisation, ensuring your AI only processes the data it genuinely needs; lawful basis for processing, particularly when using AI for automated decision-making; data protection impact assessments for high-risk processing; and individuals' rights, including the right to explanation when AI affects them.

Integrating AI governance with your existing data protection framework avoids duplication and ensures consistency. If you are developing a broader AI strategy for your organisation, governance should be woven in from the start, not bolted on afterwards.

Audit Readiness

Regulators will increasingly expect businesses to demonstrate their AI governance, not just describe it. Audit readiness means maintaining documentation that shows what AI systems you operate, how they were assessed and approved, what monitoring is in place, how incidents are handled, and what training your staff have received.

Building this documentation as you go is far easier than reconstructing it retrospectively. Every new AI deployment should generate a governance record as part of the deployment process.

Transparency Requirements

Transparency is a consistent theme across all AI regulation. At a minimum, you should disclose when customers are interacting with AI rather than a human, explain how AI-generated recommendations or decisions are made, provide clear routes for individuals to challenge AI-assisted decisions, and publish your approach to AI governance publicly.

Transparency builds trust. Organisations that are open about their use of AI consistently see higher adoption rates and greater customer acceptance than those that try to disguise it.

Practical Steps to Start Now

  • Conduct an AI inventory: Catalogue every AI system in use across your organisation, including third-party tools.
  • Classify by risk: Determine which systems fall into which risk tiers and prioritise governance efforts accordingly.

  • Assign ownership: Name an AI governance lead, even if it is a part-time responsibility initially.
  • Train your team: Ensure staff understand both the tools they are using and the governance expectations around them.
  • Monitor and iterate: Governance is not a one-off project. Build regular reviews into your calendar.

Why "Wait and See" Is Risky

Some businesses are adopting a wait-and-see approach to AI governance, reasoning that the regulatory landscape is still evolving. This is a mistake. Regulation will only tighten, not loosen.
